Introduction
Welcome to 360tour. By using our services, you agree to these terms of service. Please read them carefully. If you do not agree with any of these terms, please do not use our services.
Our Services
360tour offers professional virtual tour and web application development services. Our services include:
- Matterport and 3DVista virtual tours
- Web application and website development
- Photography and content processing
- Maintenance and support
Quote and Acceptance
We work on the basis of a written quote provided to the client. The quote includes a description of the service, timeline and price. A contract is considered concluded when the client accepts the quote in writing (email is sufficient).
Payment
Service prices are agreed individually with the client. Payment is made according to agreed terms, usually 50% in advance and 50% upon project completion. All prices are in EUR and include VAT where applicable. In case of late payment, we reserve the right to charge statutory interest.
Timelines
Delivery timelines are agreed upon in the quote. We reserve the right to extend deadlines in case of client delays in providing necessary materials or information. Virtual tours are delivered within 48 hours of shooting, unless otherwise agreed.
Intellectual Property
All materials, designs, and code created by 360tour as part of the project become the client's property after full payment. We retain the right to use projects for marketing purposes (portfolio, social media) unless the client explicitly requires confidentiality (NDA).
Liability
We strive to ensure high quality of our services, but we cannot guarantee that our services will always be available or error-free. Our liability is limited to the amount paid for the specific service. We are not liable for indirect damages, lost profits, or consequential losses.
Force Majeure
Neither party is liable for failure to perform obligations caused by force majeure (natural disasters, pandemics, war, government actions, telecommunications infrastructure failures, etc.). In case of force majeure, the parties must notify each other within 7 days.
Termination
Either party may terminate the cooperation agreement with 30 days' written notice. In case of termination, the client is obliged to pay for all services performed up to the termination date, and we are obliged to deliver all completed materials.
Consumer Protection
If you are a consumer as defined by the Consumer Protection Act (Official Gazette 41/14, 110/15), you have the right to unilaterally terminate the contract within 14 days of its conclusion, without giving a reason. Instructions for termination are available upon request.
Dispute Resolution
We will endeavor to resolve all disputes amicably. For consumers, mediation is available through the Mediation Centre at the Croatian Chamber of Economy. More information: www.hgk.hr/centar-za-mirenje.
Governing Law
These terms are governed by the laws of the Republic of Croatia. All disputes will be resolved before the competent courts in Zagreb.
Changes to Terms
We reserve the right to change these terms. We will notify clients of any changes via email or by publishing them on our website. Continued use of services after changes constitutes acceptance of the new terms.
